§1. Subject of the Agreement

  1. Under this agreement, the Broker undertakes to take actions aimed at acquiring a motor vehicle on behalf of the Client at an auction in the United States (e.g. Copart, IAAI) and organizing its transport to the place indicated by the Client.
  2. The vehicle being the subject of the import will be specified in detail in a separate Bidding Order submitted by the Client in the uCars.pl IT system.

§2. Obligations of the Parties

  1. The Broker undertakes to:
    • Verify vehicle availability at the auction.
    • Participate in the auction on behalf of the Client up to the set maximum amount.
    • Organize formalities related to the purchase (transfer of funds to the auction house).
    • Organize land transport in the USA and ocean freight to Europe.
    • Prepare documentation necessary for customs clearance (SAD, ownership documents).
  2. The Client undertakes to:
    • Indicate a specific vehicle for bidding.
    • Timely settlement of all payments (vehicle price, transport, taxes).
    • Provide documents necessary for customs clearance (copy of ID card, authorizations).

§3. Payments and Settlements

  1. The Client is obliged to pay the Verification Fee (Deposit) before entering the auction, in accordance with the Terms of Service.
  2. In the event of winning the auction, the Client undertakes to pay the purchase price of the vehicle and the auction commission directly to the Broker's or Auction House's account within 2 business days.
  3. Transport costs, Broker's commission and customs duties are payable based on issued VAT/Proforma invoices.

§4. Liability and Risk

  1. The Broker is not responsible for the technical condition of the vehicle. Vehicles sold at Copart/IAAI auctions are used, post-accident goods and sold "AS IS", without warranty.
  2. The Client declares that they are aware of the risk associated with purchasing a damaged vehicle remotely.
  3. The Broker is responsible for the professional implementation of the logistics process and due diligence in document handling.

§5. Final Provisions

  1. In matters not covered by this Agreement, the provisions of the Civil Code and the uCars.pl Terms of Service apply.
  2. Accepting the Terms of Service on uCars.pl and clicking "Bid" is equivalent to concluding this agreement in documentary form.
  3. The court competent to resolve disputes is the court competent for the Broker's headquarters.
